Ham Radio Tower Dispute

US Amateur / Ham Radio Operator Karl Reed, KB1NZQ in his dispute with his local city after he was forced to remove his radio tower.

The local Biddeford government demanded the removal of the tower after complaints were made, as the correct planning permission was not sort.

However, Reed is taking legal action, claiming his First Amendment rights and failed to give him due process when it threatened to fine his landlord $2,500 a day if the tower was not removed.

Reed believes his tower was legal as federally licensed amateur radio operators are exempt from zoning ordinances as long as the towers used are less than 35 feet in height.

“Federal laws supersede these state and zoning rules,” Reed said.

However the local government are saying that these rules apply to Telecommunications, and not to Ham Radio use.
